Govt decides to recommend to President to pardon sentence of Resham Chaudhary

KATHMANDU, May 28: The government has decided to recommend to the President to pardon the remaining sentence of Nagarik Unmukti Party (NUP) leader Resham Chaudhary who is serving a life term after being found guilty in the Tikapur massacre of 2015.

Communication and Information Technology Minister Rekha Sharma stated that a Cabinet meeting held this morning decided to recommend Chaudhary for the presidential pardon.

Chaudhary has been convicted in the Tikapur case and is serving a life sentence at the Dillibazar jail.

On the occasion of Republic Day on May 29, the punishment of several prisoners will be waived. There is a constitutional provision for the remission of punishment by the President on the recommendation of the Council of Ministers.

Article 276 provides that "the President may pardon, postpone, change or reduce the sentence imposed by any court, judicial or quasi-judicial body or administrative officer or body in accordance with the law".

The Supreme Court upheld the decision of the High Court, Dipayal, to sentence Resham Chaudhary to life imprisonment only on May 16, 2023. Chaudhary, who made a statement that he would go for a review against the Supreme Court's decision, had chosen the path of freedom from prison through the path of pardoning according to Article 276 of the Constitution.

The Cabinet meeting also decided to appoint Anita Dhungana Shah of Lamjung as a member of the National Planning Commission.
