Govt employees file petitions at SC against adjustment of civil servants

KATHMANDU, Jan 15: A day after the Supreme Court (SC) refused to issue a stay order in response to a writ petition filed against the government's plan for the adjustment of civil servants in the three tiers of government, two separate petitions were filed at the apex court on Monday, seeking the court's intervention in the matter.

While one of the two petitions was registered by the general secretary of National Employees' Federation of Nepal, Amar Singh Oli, the other petition was lodged by civil servants representing the Administration and Accounts Groups of Civil Servants. Both petitions have sought an SC order to stop the civil servants adjustment process "because it violates of the fundamental rights of the civil servants and the provisions of the Civil Service Act, 1992."

Responding to a writ petition filed by 330 civil servants including Kiran Paudel, the SC on Sunday had declined to issue a stay order against the adjustment of the existing civil servants in the three tiers of the government - federal, provincial and local.

A division bench of justices Kedar Prasad Chalise and Sapana Pradhan Malla had declined to issue the stay order, stating that there was no ground for doing so.

Stating that the government's plan to adjust the civil servants as per the Civil Servants Adjustment Ordinance issued on December 9 violates their fundamental rights and breaches the principle of career development of the civil servants as stated in the Civil Service Act, 1992, the government employees had challenged the Ordinance at the apex court.
