SC issues show cause order in a writ petition filed against NRB Governor Adhikari

KATHMANDU, Dec   29:  The Supreme Court has issued a show cause order on a writ petition filed against Nepal Rastra Bank Governor Mahaprasad Adhikari over his academic qualifications.

The single bench of Supreme Court Justice Sushmalata Mathema has issued an order in the name of the government to submit the reasons for appointing Adhikari to the post of governor. It will be heard in a double bench in  the month of Magh (mid- January).

According to Section 20 of the Nepal Rastra Bank Act, 2058, a writ was filed in the Supreme Court claiming that Adhikari was appointed as the governor without the minimum educational qualification required to be appointed to the post of governor. The Supreme Court administration registered the writ on Thursday and fixed the date of hearing for Friday.

Four advocates including Advocate Deepak Raj Joshi have made the Office of the Prime Minister and the Council of Ministers, the Ministry of Finance and the Nepal Rastra Bank defendants in the case. 

They have demanded that the appointment of Adhikari be revoked immediately. The writ petitioners have contended that a chartered accountant degree cannot be considered a postgraduate degree. 

The petitioners have demanded the apex court order to relieve Governor Adhikari from the post as he does not meet the minimum qualifications. A cabinet meeting held on April 6, 2020 had decided to appoint Adhikari as governor.
