KATHMANDU, September 15: The justices of the Supreme Court (SC) against whom suspended Chief Justice Cholendra SJB Rana leveled various charges while recording his statement before the impeachment recommendation committee have refused to come to the committee for questioning, claiming that it would be against the principle of separation of power. The committee had sent a letter to the Supreme Court, asking six justices named by Chief Justice Rana to appear before the house panel. The full meeting of the Supreme Court (including all justices ) has decided that it is unconstitutional to go to the impeachment recommendation committee for answering the questions.
The committee sent a letter to six justices , including acting Chief Justice Deepak Kumar Karki, asking them to appear at 8:30 AM on Thursday morning. The full meeting held in the Supreme Court on Wednesday decided that questioning the judges is not appropriate from the constitutional point of view. The committee has personally sent letters to Acting Chief Justice Karki, justices Hari Krishna Karki, Ishwar Prasad Khatiwada, Anand Mohan Bhattarai, Prakashman Singh Raut and Hari Phuyal for their answers.
Rana , who is facing an impeachment motion, was summoned to parliament to answer the questions asked by the recommendation committee.
The committee has also sent a letter to the ex-judge forum as an institution for its presence. Former Chief Justices Meen Bahadur Rayamajhi, Anup Raj Sharma, Kalyan Shrestha and Sushila Karki have also been called by the impeachment recommendation committee. It is said that on Thursday, former chief justices and legal professionals will be questioned separately in groups. Mahalakshmi Upadhyay, joint general secretary of the Nepali Congress, who was named by Rana, has also been called for discussion.
