JANAKPUR, July 8: Janakpur Appellate Court has issued an order to investigate the death of Rambibek Yadav.
Rambibek, a resident of Mahottari VDC-5 in Mahottari district, was allegedly killed by security personnel on September 9, 2015, in Jaleshwar during the recent political unrest in Madhes. He succumbed to bullet injuries.
After 10 months of the incident, a joint bench of judges Sheshraj Shivakoti and Purosottam Bhandari at the Janakpur Appellate Court on Tuesday issued the order in the name of District Police Office (DPO), Mahottari and District Administration Office (DAO), Mahottari to accept the First Information Report (FIR) from the petitioner, Indu Yadav, who is the father of the deceased and investigate into the killing.
The writ petition filed at the court claimed that Rambibek Yadav was a bystander. The case was led by advocate Bikru Yadav from Mahottari.
Earlier this year on January 12, Rambibek's father Indu had sent the FIR to the DPO through post office but the DPO refused to register the FIR. He then moved the court on March 27, urging the court to order the DPO Mahottari to register the FIR and make an impartial and time-bound investigation into the killing of his son. The next day after filing the writ petition, the court had issued a show cause notice in the name of Mahottari-based DPO and DAO.
Ironically, the defendants of the case are unaware of the court's decision. When Republica contacted DPO Chief SP Janak Bhattarai to learn about the office's response to the court's decision, he just said that it will be responded accordingly.
