Final hearing on Home Minister Lamichhane’s citizenship and passport case to be held from today

KATHMANDU, Jan 25: The final hearing in the case related to the citizenship and passport of Deputy Prime Minister and Home Minister Rabi Lamichhane will be held in the Supreme Court from today.

KATHMANDU, Jan 25: The final hearing in the case related to the citizenship and passport of Deputy Prime Minister and Home Minister Rabi Lamichhane will be held in the Supreme Court from today.


Questioning Lamichhane's eligibility to be a member of parliament, advocates Raviraj Basaula and others had earlier filed a writ petition on December 14 demanding the cancellation of Lamichhane's position as MP.

A Constitutional Bench held a preliminary hearing on the case on December 21 and discussed the issue of whether or not to issue an interim order on January 6. The bench had fixed the full hearing for January 25.


The constitutional bench formed under the chair of Acting Chief Justice Hari Krishna Karki consists of Justices Ishwar Prasad Khatiwada, Anand Mohan Bhattarai, Anil Kumar Sinha and Prakashman Singh Raut.


In the petition, it was claimed that Lamichhane had seriously violated the constitution and the law by saying that he had registered a party and was elected as an office bearer even as he did not retain his Nepali citizenship after obtaining American citizenship. 


Lamichhane, Rastriya Swanatra Party, Election Commission, Federal Parliament and District Administration Office, Kathmandu have been named as defendants in the writ petition.
