Hearing on case related to leader Gautam postponed till October 7

KATHMANDU, Oct 2: The Supreme Court has postponed the hearing on the case relating to the nomination of ruling party NCP Vice-Chairman Bam Dev Gautam to the National Assembly member as the time ran short today. Now, the next hearing is scheduled for October 7, Wednesday.

KATHMANDU, Oct 2: The Supreme Court has postponed the hearing on the case relating to the nomination of ruling party NCP Vice-Chairman Bam Dev Gautam to the National Assembly member as the time ran short today. Now, the next hearing is scheduled for October 7, Wednesday.


The constitutional bench comprising Chief Justice Cholendra Shumsher JB Rana and Justices Deepak Kumar Karki, Hari Krishna Karki, Bishwombhar Prasad Shrestha and Ishwor Prasad Khatiwada on September 30 had decided to hear the case today, citing the lack of time. Hearing on the case had started in the constitutional bench on September 30. The pleading on behalf of the petitioners has however been over, said Joint Spokesperson at SC, Devendra Adhikari. The lawyers on behalf of the defendants are yet to plead.

On September 23, a single bench of Justice Dr Anand Mohan Bhattarai issued an interim order asking the defendants not to give additional responsibility to leader Gautam until the final decision, arguing that it was an issue of serious constitutional importance.


Senior advocate Dinesh Tripathi had filed a writ petition, demanding the cancellation of the decision of nominating Vice-Chairman of ruling NCP Bam Dev Gautam to the National Assembly. In the writ petition, the Office of the President, Office of the Prime Minister and Council of Ministers, the ruling NCP and lawmaker Gautam have been named as defendants.
