Hearing on DIG Silwal's writ petition deferred

KATHMANDU, May 2 : The Supreme Court on Tuesday 'indefinitely' postponed the hearing on a writ petition filed by DIG Nawaraj Silwal seeking his appointment as Nepal Police chief.

KATHMANDU, May 2 : The Supreme Court on Tuesday 'indefinitely' postponed the hearing on a writ petition filed by DIG Nawaraj Silwal seeking his appointment as Nepal Police chief.


The apex court was scheduled to start the hearing on the writ petition on Tuesday but the acting Chief Justice Gopal Prasad Parjauli did not assign any bench for the trail. The apex court's joint registrar Lal Bahadur Kunwar informed about the postponement of the case having the prime minister and the Office of the Prime Minister as the defendants.

The acting chief justice reportedly decided to put off the high-profile case for no apparent reason.  

Parajuli was appointed the acting CJ on Sunday after 249 lawmakers of the ruling coalition Nepali Congress and the CPN (Maoist Center) lodged an impeachment motion against Chief Justice Sushila Karki. She was subsequently suspended from the office. 


The impeachment motion was lodged as per Article 101 (b) of the constitution, alleging CJ Karki of interfering on the executive rights of the government and delivering verdicts by distorting facts in the appointment of inspector general of Nepal Police, among others.


DIG Silwal had moved the court on April 13, a day after the government promoted DIG Prakash Aryal to the post of IGP of Nepal Police,  alleging the government of foul play in the selection of the police chief.

DIG Silwal was one of the three contenders for the top position of the security agency. He had argued that he was the rightful heir to the top post based on the principle of seniority and performance. 

But it later emerged that DIG Silwal had submitted a doctored document despite the fact that he had earned 2 points less in four years' internal appraisal than the new IGP Aryal.
