Hearing on writ petitions against HoR dissolution concludes, verdict awaited

KATHMANDU, Feb 19: With the amicus curiae presenting its opinion on the writ petitions seeking the restoration of the House of Representatives (HoR), the hearing on the case has concluded.


A member of the amicus curiae, Gita Pathak, presented her arguments on the House dissolution case on Friday at the five-member Constitutional Bench headed by Chief Justice Cholendra Shumsher JBR.

The amicus curiae comprising senior advocates Badri Bahadur Karki, Satish Krishna Kharel, Bijaya Kant Mainali, Purna Man Shakya and Geeta Pathak started presenting its arguments and opinions on the matter to help the Constitutional Bench pass a verdict on the case involving the dissolution of the lower house of the federal parliament.  


Following the conclusion of the hearing on the House dissolution case, Chief Justice JBR asked all advocates and lawyers from the plaintiffs, defendants and amicus curiae to produce their hearing notes by Feb 22.


The apex court is expected to issue the verdict anytime after Feb 23.


The constitutional bench of Chief Justice Cholendra Shumsher JB Rana and four other justices —Bishwambhar Prasad Shrestha, Anil Kumar Sinha, Sapana Malla and Tej Bahadur KC – was hearing the case since January 17 to test the constitutionality of the move of Prime Minister Oli to dissolve the HoR.


The hearing on the case had been taking place at the apex court since the second week of January after as many as 13 writ petitions were filed seeking the restoration of the 275-member HoR, which was dissolved on December 20 last year by President Bidya Devi Bhandari at the recommendation of Prime Minister KP Sharma Oli.
