Writ petition filed at SC

KATHMANDU, March 5: A writ petition was filed at the Supreme Court on Sunday demanding management of civil servants at the local levels, formation of commission on natural resources and fiscal commission as well as formulation of new laws related to jurisdictions of all the three levels of the government in line with the new constitution.

KATHMANDU, March 5: A writ petition was filed at the Supreme Court on Sunday demanding management of civil servants at the local levels, formation of commission on natural resources and fiscal commission as well as formulation of new laws related to jurisdictions of all the three levels of the government in line with the new constitution. 


Mayor of Banepa Municipality Ashok Kumar Byanju Shrestha and two others - Krishna Bahadur Khatri and Hari Chandra Timalsina - jointly filed the writ petition at the SC. The central governments, as well as the provincial governments of all the seven provinces, have been mentioned as the defendants in the case.

In the petition, the three petitioners have demanded a mandamus order from the court to the government to address their demands. The petitioners have argued that the federal government should take suggestions from all the local units while formulating new laws and fixing jurisdiction of all the three levels of the government. 


They have also asked the apex court to order the government to immediately form a natural resource and fiscal commission for the division of revenue among the three levels of the government and table the budget based on the recommendation of the commission. 


Similarly, the apex court has been asked to order the government not to transfer the government officials who have been currently deployed at the local levels for the time being unless the government formally integrates civil servants in the new federal setup.
