Writ petition seeking mandamus on garbage management

KATHMANDU, Sept 17: A writ petition has been filed at the Supreme Court against the government demanding a mandamus to properly manage the garbage produced in the Kathmandu Valley.


Invoking Article 133 (3) of the Constitution of Nepal, Advocate Padam Bahadur Shrestha on Monday filed a writ petition at the Apex Court demanding to issue a mandamus to this effect.


In the writ petition, it has been suggested that the SC should issue a ruling in such a way that the rubbish produced in the Kathmandu Valley would be segregated into bio-degradable and non-bio-degradable and collected accordingly.

It has been further suggested that the garbage collectors also should pick the garbage separately by using separate vehicles.


“Since Sisdole landfill site has already been filled to capacity, the govern should immediately look for an alternative landfill site to manage the rubbish of the Kathmandu Valley,” reads the writ petition further.


According to the writ petition, the garbage producers should be charged as per the amount of the rubbish they produce.


Ministry of Forests and Environment, Ministry of Health and Population, Ministry of Federal Affairs and General Administration, Office of the Prime Minister and the Council of Ministers, Department of Environment, Kupondole, Garbage Management and Technical Support, Pulchowk, Kathmandu Metropolitan City, Bag Durbar, Lalitpur Metropolitan City and Bhaktapur Municipality have been mentioned as defendants in the writ petition.


It is learnt that around 1,000 tons of garbage are produced in the Capital on a daily basis of which 80 percent can be recycled.
