KATHMANDU, July 19: The Judicial Council (JC) has begun to investigate and recommend action against judges with bad conduct.
A meeting of JC held on Monday recommended the dismissal of Judge Rakesh Kumar Nidhi of High Court Dipayal, Mahendranagar Bench, and Kathmandu District Court Judge Anil Kumar Sharma.
Judge Nidhi of the High Court was being investigated for three years and Sharma of the Kathmandu District Court for one and a half years based on the complaint filed at the JC.

JC Spokesman Man Bahadur Karki said that the decision to dismiss both judges was made as they demonstrated weaknesses in handling cases. With the decision of the JC, the number of judges facing dismissal has reached five.
Earlier, the JC had recommended dismissing Judge Nasrullah Ansari of Jumla Bench of High Court Surkhet and Judge Lok Jung Shah of Bardia District Court.
Prior to that, the JC meeting held on June 29 had recommended dismissal of High Court judge Renuka Shah. A complaint was filed against Shah, who had been handling the case in the Butwal Bench of the High Court, Tulsipur for more than three years. The decision to dismiss Shah was made on the grounds that she had not completed 10 years as an advocate when her appointment as judge was made.
Officials at JC said complaints have been filed against more than 200 judges serving across the country. The JC said that these complaints are being investigated.
The Constitution provides that the Chief Justice of the High Court, Judges and District Court Judges may be removed from court for lack of efficiency, bad conduct and not fulfilling their duties honestly. In the same way, there is a provision that the Chief Justice can dismiss the judge on the recommendation of the Judicial Council in case of violation of the code of conduct.
According to the existing federal law, judges, who have been removed from court, will not receive any benefits other than the amount of the reserve fund and insurance.
