KATHMANDU, Sept 29: Arguing that the testing of court orders by irrelevant individuals, authorities and processes would undermine the independence of the judiciary, Chief Justice Cholendra SJB Rana has urged one and all to respect court orders.

“Court orders may be reviewed according to the process set forth in the law. Otherwise, it would be against the principle of independence of the judiciary and the value of the judiciary,” he said.
Chief Justice Rana also underlined that assurance of independence of judiciary, assurance of its autonomy and proper exercise are always significant. “An independent, impartial and competent judiciary as expected by the constitution is also our expectation,” he said, adding, “Which can only be protected through constitutionalism, democracy, rule of law and human rights.”
Arguing that the independence and autonomy of the judiciary could not be enough only by making constitutional provisions, the CJ also underlined respectful conduct by every individual in line with the principle of independence of the judiciary. Rana’s remarks come at a time when some verdicts including Ncell’s capital gains tax determination and Gorkha Brewery’s income tax determination courted serious controversy and people have started questioning the integrity of the judges and justices concerned.
