Five posts, including CJ, vacant in SC; increasing pressure of cases and workload

KATHMANDU, March 1: The Supreme Court (SC) has a constitutional system of 21 justices including the Chief Justice. Due to the expiry of the tenure of the justices in the SC due to the age limit, now the posts of five justices including the Chief Justice are vacant.

KATHMANDU, March 1: The Supreme Court (SC) has a constitutional system of 21 justices including the Chief Justice. Due to the expiry of the tenure of the justices in the SC due to the age limit, now the posts of five justices including the Chief Justice are vacant.  


A justice said that the number of justices in the SC has been decreasing due to the lack of appointments, increasing the workload.

The recommendation made by the Judicial Council for the appointment of three justices to the SC has not yet been heard in parliament. On September 6 last year, the Judicial Council recommended High Court Chief Judges Nita Gautam Dixit and Binod Sharma Gautam and head of Nepal Law Campus DN Parajuli for appointment as justices of the SC.


The SC could not get justice because the term of the previous parliament ended without a parliamentary hearing. The Judicial Council is not yet complete to recommend the appointment of other justices. The Minister for Law, Justice and Parliamentary Affairs who is a member of the Judicial Council is not present. After the resignation of Law Minister Dhruba Bahadur Pradhan, no new minister has been appointed.


A member of the Judicial Council said that since this ministry is currently under the responsibility of Prime Minister Pushpa Kamal Dahal, there was a discussion about making a decision and signing it. In the meeting of the Judicial Council called on Sunday, no decision could be taken due to the lack of quorum due to the absence of the Law Minister. Man Bahadur Karki, spokesperson for the Judicial Council, said that no decision could be taken due to the lack of quorum even though the meeting was held.
