Joint bench of Justices Malla and Mathema to hear case against Koshi CM Thapa

KATHMANDU, Sept 3: The hearing of the writ petition against the Koshi government is taking place today. The hearing scheduled for today has been assigned to a joint bench of Justices Sapna Pradhan Malla and Sushmalata Mathema. According to the Supreme Court, the hearing of the writ petition has been scheduled in 'A' of bench No-5.

KATHMANDU, Sept 3: The hearing of the writ petition against the Koshi government is taking place today. The hearing scheduled for today has been assigned to a joint bench of Justices Sapna Pradhan Malla and Sushmalata Mathema. According to the Supreme Court, the hearing of the writ petition has been scheduled in 'A' of bench No-5.


Earlier, the hearing scheduled for Friday was adjourned after Justice Ishwor Prasad Khatiwada refused to conduct the hearing. He refused to see the case saying that he had already given his point of view during the preliminary hearing.

On August 24, the bench led by Khatiwada had issued an order, stating that the person presiding over the provincial assembly meeting should refrain from making long-term and policy decisions, asserting that it was unconstitutional for him to vote for a motion of confidence.


Before that, on August 21, Chief Minister (CM) Uddhav Thapa had announced that he got the vote of confidence by using the vote of the Speaker in the Koshi Provincial Assembly and former Chief Minister Hikmat Kumar Karki had filed a petition in the Supreme Court, arguing that obtaining a vote of confidence in such a manner was unconstitutional.
