Justice Karki stays out of Constitutional Bench after lawyers raise question about his conflict of interest

KATHMANDU, Jan 6: Justice Hari Krishna Karki has decided to abstain from the Constitutional Bench after lawyers making case against the decision of Prime Minister K P Oli to dissolve the lower house of the federal parliament objected to his presence.

KATHMANDU, Jan 6: Justice Hari Krishna Karki has decided to abstain from the Constitutional Bench after lawyers making case against the decision of Prime Minister K P Oli to dissolve the lower house of the federal parliament objected to his presence.


Arguing that Karki had earlier served as Attorney General of Prime Minister K P in his previous stint, the lawyers maintained that Karki will have potential conflict of interests in the case. Karki decided to leave the Constitutional Bench after lawyers pleading on behalf of the petitioners repeatedly raised this issue.

Chief Justice Cholendra SJB Rana had earlier formed a five-member constitutional bench under him. The bench includes Justices Bishwambhar Prasad Shrestha, Tej Bahadur KC, Anil Kumar Sinha and Karki. A new justice will be included in the bench now.


Meanwhile, the ongoing hearing on the writ petitions filed against the House dissolution at the apex court has been put off for another week. The hearing has been postponed as justices and lawyers expressed differing views over whether to form a larger bench or continue hearing at the Constitutional Bench.
