KATHMANDU, Dec 11: The writ petition filed by member of the House of Representatives, Dr Amresh Kumar Singh, against the case of Ncell share purchase and sale in the Supreme Court, has been scheduled for hearing by the single bench of Justice Binod Sharma.
The petition finds the second last spot on the list of cases to be heard by the bench today. Today 26 cases are scheduled for hearing by Justice Sharma's bench. The writ petition filed in the single bench of Justice Kumar Regmi on Sunday was not sent for hearing today.
Hearing begins on case filed against Ncell by MP Singh
On the other hand, Singh, a member of the House of Representatives, himself filed a writ petition, claiming that the shares of the private sector telecommunication service provider Ncell were bought and sold in an opaque manner that would harm the country by distorting the legal process. MP Singh has said that he will take off the parliament logo and debate on his own.
Earlier, a short-term interim order has been issued in the writ petition filed against Ncell in Patan High Court. An order has been made to stop the process of buying and selling shares of Ncell. Even according to the order of the High Court Patan, Ncell is not allowed to sell shares.
The dispute arose after Malaysia's Axiata Company, which bought 80 percent of Ncell's shares seven years ago for Rs 1.44 trillion, recently sold it to Spectrlite UK, a British company founded by Nepali, for a total of Rs 6.5 billion.
The writ petitioner, MP Singh, registered the case on Friday. The Office of the Prime Minister and Council of Ministers, the Ministry of Communications and Information Technology, the Nepal Telecommunications Authority, the Office of the Registrar of Companies, the Inland Revenue Department and Ncell have been made defendants in the case.
