KATHMANDU, August 9: Defendants have been acquitted in an ‘abatement to suicide’ case at Samata Hospital in Boudha.
A joint bench of judges Mahesh Sharma Poudel and Mina Gautam Sedai at Patan High Court upheld the earlier order of the Kathmandu District Court.
Bimala Tamang's kin prepare to move apex court
In the suicide of Bimala Tamang, who was working in the hospital set up by Uttam Sanjel, the director of Samata School, an abatement to suicide case was filed against Bishnukala Khatri alias Kala Sanjel and two others working in the hospital, namely Tirtha Kumari Shrestha and Sangita KC.
Tamang went missing on June 17, 2019 and her body was found in the inner room of the hospital the next morning. Tamang's husband Buddhiraj Yonjan had filed a case against Khatri, Shrestha and KC for inciting her to commit suicide.
The Kathmandu District Court had cleared the defendants on April 2, 2020. In the case filed against the order, the Patan High Court has upheld the order issued earlier by the Kathmandu District Court. The District Court had ruled that the case could not be substantiated as the husband of the deceased could not easily accept the news of his wife's sudden death, prompting him to file an ‘abetment to suicide’ case.
The High Court order said that the decision of the District Court to acquit the accused could not be reversed as it did not need to be changed.
