KATHMANDU, March 27: A single bench of Justice ordered to register the case filed at the Supreme Court (SC) against the oath taking administered by former Chief Justice Gopal Parajuli to President Bidya Devi Bhandari, arguing that it was unlawful.
A single bench of Justice Ishwar Prasad Khatiwada on Tuesday directed the SC administration to register the case against the President’s oath-taking saying that it triggered discourse on the legal gamut as Parajuli had already received a retirement letter from Nripdhwaj Niraula, secretary of the Judicial Council by the time.
Parajuli had already received the letter when he administered the oath of office and secrecy to President Bhandari at 4 pm on March 14. Parajuli stepped down on March 15.

Earlier, SC administration had turned down a writ petition filed by advocate Narayan Kharel arguing that it was unconstitutional to administer oath of office and secrecy to the President by the already retired Chief Justice.
The issue regarding whether the President’s oath is legal has again become the issue of discourse in the Supreme Court after the bench of Justice Khatiwada ordered to revive the case.
