SC denies stay order on DIG petition

KATHMANDU, April 12: The Supreme Court on Wednesday did not grant stay on the writ petition filed by DIG Nawaraj Silwal against the government's appointment of Prakash Aryal as the Inspector General of Nepal Police.

KATHMANDU, April 12: The Supreme Court on Wednesday did not grant stay on the writ petition filed by DIG Nawaraj Silwal against the government's appointment of Prakash Aryal as the Inspector General of Nepal Police.


A single bench of Justice Ishwar Prasad Khatiwada, however, has ordered the government to furnish a written reply by April 28 over the appointment of Aryal as inspector general.

The court in its order has stated that there is no need of stay order as per the principle of balance of convenience citing that it might hamper the chain of command as the newly-appointed IGP has already taken the charge of the Nepal Police.


The government on Monday had appointed Aryal to the post. Following the appointment, DIG Silwal had filed the petition on Tuesday challenging the government decision. Silwal demanded in the petition that Aryal's appointment be scrapped and he be appointed to the post. 


Prior to this, on February 12, the government had appointed Jaya Bahadur Chand as the IGP, prompting Silwal to challenge the appointment in the court. In response, the SC had ordered the government to appoint a new police chief on the basis of work performance.
