SC stays EC's decision to make it mandatory for elected officials to resign before nomination for local polls

KATHMANDU, March 22: The Supreme Court (SC) has stayed the decision of the Election Commission (EC) to make it mandatory for all elected people's representatives to tender resignation from their respective posts before filing nomination for the upcoming local level polls.

KATHMANDU, March 22: The Supreme Court (SC) has stayed the decision of the Election Commission (EC) to make it mandatory for all elected people's representatives to tender resignation from their respective posts before filing nomination for the upcoming local level polls.


 A single bench of Justice Bam Kumar Shrestha issued the short term order against the EC not to implement the decision until March 27. The order was issued in response to a writ petition filed by Chairman of Helambu Rural Municipality in Sindhupalchowk Nima Gyaljen Sherpa. He had named the Election Commission and various government bodies defendants in his writ petition.

The Shrestha-led bench has invited both the parties for discussion before issuing the next order on March 27.
