Sexual and gender minorities knock on SC doors demanding inclusive state structures

KATHMANDU, Jan 15: Sexual and gender minorities have filed a writ petition at the Supreme Court, demanding that they should be able to represent themselves in the State apparatus in line with the principle of proportional inclusiveness.

KATHMANDU, Jan 15: Sexual and gender minorities have filed a writ petition at the Supreme Court, demanding that they should be able to represent themselves in the State apparatus in line with the principle of proportional inclusiveness.


Four persons, including Secretary of the Mayako Pahichan Nepal, Surendra Pandey, have made the Office of the Prime Minister and Council of Ministers; Ministry of Law, Justice and Parliamentary Affairs; federal parliament; and Public Service Commission as defendants in the petition. They have demanded that they should be allowed to participate in the state organs as per provisions enshrined by the constitution.

Article 42 of the Constitution of Nepal has recognized the rights of sexual and gender minorities.


Demanding a mandamus for amendment in the prevailing laws, the petition read, "The rights of the sexual and gender minorities have not been addressed in the vacancies announced by the Public Service Commission for recruitment in various positions within the state organs."


The rights of their communities had been violated, thereby affecting the rights to get a job in public offices and the right to live a dignified life. It may be noted that Sunil Babu Pant was first from this community to be elected Constituent Assembly member.


The hearing on the writ is scheduled for January 16.
