24 writ petitions filed in SC demanding reinstatement of dissolved parliament

KATHMANDU, May 25: A total of 24 writ petitions were filed in the Supreme Court on Monday seeking reinstatement of the dissolved House of Representatives (HoR).

KATHMANDU, May 25: A total of 24 writ petitions were filed in the Supreme Court on Monday seeking reinstatement of the dissolved House of Representatives (HoR). 


After President Bidya Devi Bhandari announced the dissolution of the HoR at the recommendation of Prime Minister KP Sharma Oli, the writ petitioners lined up in the apex court on Monday to file their separate writ petitions.


A total of 28 writ petitions were registered, of which 24 are in favor of reinstatement of HoR.

Meanwhile, four writ petitions have been filed demanding that Oli remains the Prime Minister and elections be held on time. 


Nine writ petitions have been registered in the Constitutional Court. There will be hearings from 15 single sessions.


A five-member bench including Chief Justice Cholendra Shamsher JB Rana will hear the case in the Constitutional Court. Members of the dissolved House of Representatives, senior advocates and advocates have filed separate writ petitions against the dissolution of the HoR for the second time.


President Bidya Devi Bhandari announced the dissolution of the HoR for the second time in her five-year tenure as the president, as per the recommendation of the cabinet meeting held at midnight on Saturday. The dissolution, which took place on December 20, 2020, was reinstated by the Supreme Court on February 23, 2021.


The writ petitioners claim that it is unconstitutional for the Prime Minister KP Sharma Oli to dissolve the HoR without taking a vote of confidence and resigning from his post. All the writ petitioners have demanded the reinstatement of HoR. Four writ petitions have been filed in favor of Prime Minister Oli, demanding timely elections.
