KATHMANDU, May 7: The Nepali Congress (NC) has filed a writ petition at the Supreme Court (SC) against the announcement that Chief Minister (CM) Khagaraj Adhikari has received a vote of confidence in Gandaki with the support of 30 MPs.
Surendra Raj Pandey, the leader of the Gandaki Province Assembly Parliamentary Party of NC, said that CM Adhikari fraudulently announced that he had received a vote of confidence when he had not received the vote of confidence.

Pandey said that the chief minister, appointed under Article 168 (2) of the constitution, was automatically dismissed without a confidence vote and insisted on being appointed as the chief minister due to his leadership of the major party in the provincial assembly.
Despite only 30 votes being cast in CM Adhikari's confidence motion last Sunday, Speaker Krishna Dhital declared that the Chief Minister had received the vote of confidence.
With the province assembly comprising 60 members, the chief minister required support from 31 MPs for a confidence vote. An NC provincial assembly member in Gandaki Province, Dilliram Subedi, said that since the Speaker's announcement was unconstitutional, he has filed a writ petition against it in the Supreme Court.
The petition is scheduled for hearing on May 9.
