Supreme Court seeks details of impeachment motion filed against Cholendra SJB Rana

KATHMANDU, Feb 8:  The Supreme Court has ordered the concerned authorities to submit the report prepared by the impeachment recommendation committee against the suspended Chief Justice Cholendra Shumsher JB Rana.

KATHMANDU, Feb 8:  The Supreme Court has ordered the concerned authorities to submit the report prepared by the impeachment recommendation committee against the suspended Chief Justice Cholendra Shumsher JB Rana.


Devendra Dhakal, information officer of the Supreme Court, said that the Constitutional Bench of SC on Wednesday issued such an order seeking details of the status of the report that was approved by the then Speaker of the House of Representatives.


"The Constitutional bench has ordered to submit the report prepared by the committee about the suspended Chief Justice JB Rana which was approved by the HoR Speaker," said Dhakal.

He said that a full bench of SC comprising Acting Chief Justice Hari Krishna Karki and Justices Bishowambhar Prasad Shrestha, Dr Anand Mohan Bhattarai, Sapna Pradhan Malla and Tank Bahadur Moktan issued the order.


The apex court sought the details in response to a writ petition filed against the letter issued by the General Secretary of the Federal Parliament Secretariat, Bharatraj Gautam, which invalidated the suspension of now retired Chief Justice JB Rana allowing him to return back to work days before his retirement.


Lawmakers of the ruling alliance had filed an impeachment motion against CJ Rana at the federal parliament secretariat demanding removal of CJ Rana on February 11. A total of 98 lawmakers of the erstwhile parliament had signed in the impeachment motion. 


Although it was the constitutional bench led by CJ Rana himself that reinstated the parliament that was dissolved by the then Oli-led government, there are apprehensions among the leaders of the ruling parties that Rana was acting at the behest of CPN-UML Chairman K P Oli.  The Deuba-led government was formed after the CJ-led constitutional bench reinstated the parliament.


CJ Rana is accused of repeatedly deferring the hearing on the case related to the appointments made by the Oli-led government in various  constitutional bodies even as the CC meeting was held without the participation of House Speaker and the opposition party leader. Ruling party leaders alleged that CJ Rana planned to disband Madhav Kumar Nepal-led CPN (Unified Socialist) party, whose support was crucial for the survival of the Sher Bahadur Deuba-led government.
