Sitaula had served as Judicial Council member in past as well. Following the promulgation of the new constitution, Sitaula's name was forwarded again to the PHSC for hearings by the then prime minister Sushil Koirala as there was confusion that whether the council members should go through the hearing process or not. But following a change of government, the new government of KP Oli decided to withdraw Situala's name from the parliamentary committee.

The government decision to withdraw Sitaula's name had provoked political tussle between Nepali Congress and CPN-UML. This time, he has been nominated by the NBA, where democratic lawyers affiliated with NC has a majority in the executive committee.
