KATHMANDU, Dec 25: The Supreme Court has directed Kavrepalanchwok District Court (KDC) to appoint sign language interpreter to proceed with the hearings in a case related to property dispute as the victims are mute.
A single bench of Justice Anil Kumar Sinha directed the KDC to proceed with the remaining hearings in the case only after appointing sign language interpreter.
KMC to appoint sign language interpreter
The bench was responding to a writ petition filed by Hima Devi Uprety stating that there is a need for proper communication in the case which is currently sub-judice at the KDC.
Uprety had filed lawsuit at the KDC demanding court intervention to provide property to her brothers Gopal Prasad Mainali and Balkrishna Mainali, who cannot speak, after they were expelled from their home by their elder brother and nephews.
The petitioner has argued that the victims were forced to take shelter in others’ home as servants.
Advocates Ananta Raj Luitel and Bikash Bhattarai have been providing legal assistance to the speech impaired Mainali duo.
She has also mentioned in the writ that the defendants have taken her mute brothers hostage after she filed the lawsuit at the KDC. She has also sought apex court intervention for their release.
